Privacy notice
Tyler Smith and Estate Sales Office (Pty) Ltd respect your privacy and aim to process personal information in line with South Africa’s Protection of Personal Information Act 4 of 2013 (POPIA).
Information you provide
If you contact Tyler directly, your email or enquiry may include your name, contact details, property interests and the information you choose to share. Further information may be required for property transactions, mandated checks and statutory compliance, including FICA, where appropriate.
How information is used
Information may be used to respond to your enquiry, provide property services, arrange viewings, assess buyer or seller requirements, prepare transaction documents and meet applicable legal duties. Marketing communications should be sent only where a lawful basis exists, and you can ask to stop receiving them.
Enquiry form on this website
When enabled, the contact form securely transmits your name, email address, optional telephone number, property interest, message, and your consent choices to a Cloudflare-hosted enquiry endpoint. The endpoint validates submissions using Cloudflare Turnstile and, when configured, forwards enquiries by email directly to Contact Tyler using an email delivery provider. Marketing permission is optional and separate from your enquiry. The website does not intentionally maintain its own lead database. Messages and delivery records may be retained by the email provider and Tyler’s mail host in line with their policies. Automatic transfer to PropCon is not enabled at this stage.
Website property assistant
The property assistant uses this website’s published listings and area guides. Questions and recent conversation context are processed by Cloudflare Workers AI to generate answers. Do not share identity documents, banking details or other sensitive information in chat. The site code does not save chat transcripts or add chat visitors to a mailing list. A short-lived, hashed technical identifier is used for request limits. Cloudflare may process technical and service data under its own policies.
Choosing Message Tyler prepares a WhatsApp message or email on your device. You review and send it through the selected service; the assistant does not deliver it automatically. WhatsApp, your email provider and Tyler’s communications providers apply their own privacy and retention practices. Assistant answers may be incomplete; confirm prices, availability and property or estate requirements directly with Tyler.
Third-party services
Cloudflare hosts the website and handles security checks, including Turnstile. If the enquiry service is connected, the configured email delivery provider and Tyler’s email host may process personal information to deliver and manage enquiries. Their servers may be outside South Africa; appropriate arrangements for cross-border handling of personal information should be reviewed. The website also links to third-party property portals and other independent websites, which apply their own privacy policies.
Security and retention
Information received via email or during a transaction should be safeguarded through appropriate organisational and technical measures and retained only for legitimate operational or legal purposes. Retention periods can depend on statutory obligations and the nature of the service.
Your rights
Subject to the law, you may ask for access to information held about you, correction of inaccurate data, deletion where applicable, or withdrawal of marketing consent. You may also object to certain processing and contact South Africa’s Information Regulator about privacy concerns.
